A K3 marriage visa is a type of program that allows a US citizen to bring their foreign spouse or fiance to the United States. This type of visa is a non-immigrant program that enables the the couple to reunite and live together in America. Once their application is approved at a consulate in the foreign person’s, they can then travel to be with their partner and wait for their green card to be processed.
This program is applied at the country where the marriage took place which is usually at the nearest consulate. Any unmarried children of the foreign spouse can apply for a k4 visa. Once they arrive to the US, they can they file form I 485 which is for Adjustment of Status. They can also apply for an Employment Authorization card which allows them to work in any of the US states. Upon approval of the the form I 485, the individual can apply for a social security card.
A passport, birth certificate, finger print copies and any annulment of marriages done in the past have to be presented to the interviewing officer. These have to be original as there is a possibility of alterations which the embassy can decline. If there is an absence of any documents, it can lead to a delaying of the case or complete denial.
A medical examination is mandatory for all applicants in this category;it should be done by panel of approved physicians and the consulate provides the list to the applicant who then chooses the most convenient doctor based on where they live. Vaccinations are also necessary especially if one does not have an immunization card. The applicant ca get vaccinated at this stage or when they apply for an adjustment of status.
An Affidavit of Support is filed with immigration to prove that one is able to take care of themselves while in the country. If they are not working, their American spouse or fiance should show that they are able to take care of their partner once they arrive into the country. The government does not want to have many applicants straining the welfare system.
In order to improve chances of having an application approved by the interviewing officer, one must have stayed within the allocated visa period in other visa visits.
